2. Reference and links
In its sentence dated 12 May 1998 the Regional Court (“Landgericht”) Hamburg decided that the publication of a link may make the website host partly responsible for the contents of the site to which the link leads. The RC stated such responsibility can only be prevented if the website host expressly repudiates those contents.
Should reference be made directly or indirectly to links being outside the range of responsibility of APW Lehmann Automobile GmbH, the latter can only be held liable if it knows the contents and it would be technically possible and reasonable to prevent the use in case of illegal contents. All contents beyond that and especially damage originating from the use or non-use of information offered that way make the host of those sites solely liable, not the one just referring to the relevant publications via links. That restriction also applies to external entries in guest books, discussion forums and mailing lists.
